SWIM Terms & Conditions
I. Reservation Information
By participating in a SWIM eco tour, you assume certain obligations to Loggerhead Marinelife Center and the other tour participants. It is your responsibility to:
• Understand the implications and conditions of your tour’s activity level and ensure it is appropriate for your interests and abilities
• Review your trip confirmation and packing list to ensure you are properly prepared for your scheduled activities
• Obtain all necessary travel visas, passport, passport card, or any other required travel documentation.
• Complete the trip itinerary as scheduled (or as adjusted by your tour guide)
• Respect the objective of the included service project and follow the lead of your tour guide to minimize your impact on your environment.
By signing this pledge, you confirm your understanding of the above responsibilities and that Loggerhead Marinelife Center reserves the right to decline, accept or retain any tour participant should such person’s behavior, health or mental condition impede the operation of the trip.
II. Cancellation Policy
We reserve the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of tour guests. Loggerhead Marinelife Center (LMC) reserves the right to cancel any tour at any given time for any reason. Should a tour be cancelled by LMC, full refunds will be issued to each registrant. However, LMC is not responsible for additional expenses incurred by the guest in preparing for the trip (e.g., non-refundable plane tickets, visa fees, gear or medical expenses).
This cancellation policy applies to the date of registration, not payment processing. No refunds are issued less than three months to the tour departure date. The following cancellation policy applies to all eco tours and are refunded on the following scale:
More than 120 days – No fee
120 days – 50% of trip cost
90 days – 100% of trip cost
III. Third Party Contractors
Select SWIM programs require independent contractors to provide transportation, guide services or all other related travel services. We assume no responsibility, however caused, for injury, loss or damage to person or property in connection with any service provided by an independent contractor. I acknowledge that Loggerhead Marinelife Center has no control over and assumes no responsibility for the actions of any independent contractors providing any services for the Activity.
IV. Other Terms and Conditions – I have carefully read Loggerhead Marinelife Center’s Reservation Information, Cancellation Policy, detailed trip itinerary (including activity level), all other content related to my selected tour, and have familiarized myself with all of the information provided to me about the Activity and its rating. I agree to all of the conditions in the Reservation Information- including the sections about my responsibilities and about Loggerhead Marinelife Center’s legal limitations.
V. Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement (“Agreement”)
In consideration of participating in a SWIM eco tour program (hereafter “Activity”), I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity.
I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “Releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity.
I hereby release, discharge, and covenant not to sue Loggerhead Marinelife Center, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations; and I further agree that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost which any may incur as the result of such claim.
I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it, and have agreed to it freely and without any inducement or assurance of any nature, and intend it be a complete and unconditional release of all liability to the greatest extend allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
I have fully informed myself of the contents of this agreement by reading it before accepting its terms and conditions. No oral representations, statements or other inducements to sign this release have been made apart from what is contained in this document.
